COUNCIL OF ENGINEERS ITS FORMATION
Council of Engineers is an association of Building Engineers & all its Fellow Members are Chartered Engineers certified by Institution of Engineers (India), Kolkata, a statutory body of Engineers of India. It was formed on April 22, 2016 to safeguards the Fundamental Rights of Engineers as well to give well deserved recognition to Engineers in Society.
REGULAR FOLLOW-UP WITH DEPARTMENT OF LOCAL GOVERNMENT, PUNJAB:
It is well known fact that there is unnecessary tussle or resistance being faced by Civil Engineers in regard with Preparation of Building Plans & information connected with its permit to be submitted with various Local Bodies like MCs, Improvement Trust, PUDA, GLADA, GMADA etc. in Punjab. Civil Engineers in Punjab have always been allowed to submit building plans & information connected with its permit. However, in 2017, the Department of Local Government, Govt. of Punjab started avoiding Civil Engineers intentionally & ignored the Objections & Suggestions sent by Hundreds of Civil Engineers. The department was inviting only a private body of Architects to the meeting/workshops organized by Local Govt. Department.
COUNCIL OF ENGINEERS FILES WRIT PETITION AGAINST UNCONSTITUTIONAL ACT OF STATE OF PUNJAB:
Since Engineers were not given fair opportunity to be heard and only Architects were being invited by sending invitation to a private body namely, “Indian Institute of Architects” for all meetings and workshops by the department, Council of Engineers filed a writ petition in Hon’ble High Court of Punjab & Haryana (CWP -20105 of 2017) and got orders of stay on finalization of Punjab Model Building Bye-laws, 2017. Before next hearing of case, the department sent invitation to my client, i.e., Council of Engineers for holding a meeting with the Additional Chief Secretary, and the case was accordingly disposed of by the Hon’ble High Court on next date. The Office Bearers of Council of Engineers & other Associations met the Additional Chief Secretary, Sh. Satish Chandra, on 16-9-2017 and entire matter was discussed based on competency of Engineers as defined under Prefatory Note of Architects Act, 1972, National Building Code of India, 2016 and as per the directions of Hon’ble Supreme Court and various High Courts of India in favour of Civil Engineers. After hearing and discussing all the issues, the Additional Chief Secretary announced in the hall that Civil Engineers will also be allowed to continue to practice for Preparation of Building Plans and information connected with its permit for Department of Local Government, Punjab.
PUDA PERMITS CIVIL ENGINEERS TO SUBMIT BUILDING PLANS WITH PUDA/GLADA/GMADA ETC.:
PUDA had issued a draft notification for Model Building Bye-laws in which Civil Engineers were not being allowed to submit Building Plans. Since department of Housing and Urban Development was registering Civil Engineers to submit building plan since 2001-01. Council of Engineers strongly sent objections to Unconstitutional Acts of the department. The Office Bearers of Council of Engineers met Additional Chief Secretary at PUDA Bhawan and submitted their representation with request to allow Civil Engineers too. However, the ADS mentioned that they will continue the process which is being followed by them since last many years. Council of Engineers through its President clearly indicated to file Writ Petition in Punjab & Haryana High Court.
RESULT: PUDA in November added Civil Engineers and uploaded the amended draft on their website. In June, 2018 Department of Housing & Urban Development (PUDA), Govt. of Punjab issued a notification and allowed Civil Engineers to get registration with PUDA/GLADA/GMADA etc.
COUNCIL OF ENGINEERS STEPS AGAINST UNCONSTITUTIONAL ACTS OF DEPARTMENT OF LOCAL GOVERNMENT:
Department of Local Government, Punjab issued a letter/circular no. CTP(LG)-2018/2231-2232 dated 27-07-2018 addressed to the Commissioners, Municipal Corporation of Amritsar, Jalandhar, Ludhiana, Patiala, Bathinda etc., and the Regional Deputy Directors, Department of Local Govt. regarding decision to implement online building plan approval system in all the Municipal Towns of Punjab. The department had scheduled training program on 31-07-2018 at 11 AM in the office of Punjab Municipal Bhawan, Chandigarh. However, the department once again invited only Registered Architects and professionals by sending invitation again to private body, Indian Institute of Architects, to the meeting, despite knowing the fact that Civil Engineers are equally competent, the department by acting in a discriminatory manner, intentionally didn’t invite Civil Engineers.
Council of Engineers acting immediately sent a protest representation to the Principal Secretary and Additional Chief Secretary on 27th July, 28th July as well as on 30th July against the discriminatory behavior of Local Bodies Department against Civil Engineers vis a vis Architects and requested for inviting Council of Engineers. However, the department didn’t move an inch to rectify this serious mistake, which is going to affect the livelihood of hundreds of Engineers in Punjab.
COUNCIL OF ENGINEERS HOLD PEACEFUL PROTEST OUTSIDE DEPARTMENT OF LOCAL GOVERNMENT, PUNJAB AT CHANDIGARH
The Council of Engineers hold peaceful protest outside department of Local Government, Punjab Municipal Bhawan, Chandigarh on 31-07-2018, where the training program for Architects and others organized by the department was going on.
COUNCIL OF ENGINEERS SENDS LEGAL NOTICE TO DEPARTMENT OF LOCAL GOVT. ON 3-8-2018 FOR EXCESSIVE ADVANTAGE TO ARCHITECTS VIS A VIS ENGINEERS BY KEEPING ENGINEERS UNDER THE HEAD “ARCHITECTS”
Moving further, Council of Engineers sent a legal notice to the Principal Secretary as well as Additional Chief Secretary of Department of Local Government against excessive advantage given to Architects vis a vis Civil Engineers in registration for Online Building Plan Process.
OUTCOME: The department rectified its mistake to some extent and changed the option of “New Architect Registration” to New Professional Registration”. However, excessive advantage to Architects still exists as they are being allowed to register themselves based on their CoA registration Number whereas Civil Engineers will have to get registration no. from Municipal Corporations
COUNCIL OF ENGINEERS FILES WRIT PETITION IN PUNJAB & HARYANA HIGH COURT:
CoE filed writ petition against department of Local Government for giving excessive advantage given to Architects. The WP was heard and Hon’ble court passed the orders with directions to both the respondents to take required action, if any, thereon expeditiously and preferably within a period of two months from the date of receipt of a certified copy of orders.
COUNCIL OF ENGINEERS (COE) IS AGGRESSIVELY ACTING AGAINST ALL UNCONSTITUTIONAL ACTS OF VARIOUS DEPARTMENTS WHICH ARE VIOLATIVE TO FUNDAMENTAL RIGHTS OF CIVIL ENGINEERS AND WILL CONTINUE TO DO SO TILL CIVIL ENGINEERS ARE RECOGNISED SEPARATELY AND DIRECTLY UNDER ACT OF PARLIAMENT I.E. CIVIL ENGINEERS BILL.
